{"id":48261,"date":"2026-08-20T20:07:26","date_gmt":"2026-08-20T13:07:26","guid":{"rendered":"https:\/\/marapipost.com\/?p=48261"},"modified":"2026-08-20T20:08:58","modified_gmt":"2026-08-20T13:08:58","slug":"majelis-hakim-pengadilan-n-pasbar-jatuhi-hukuman-10-tahun-penjara-kepada-mi","status":"publish","type":"post","link":"https:\/\/marapipost.com\/index.php\/2026\/08\/20\/majelis-hakim-pengadilan-n-pasbar-jatuhi-hukuman-10-tahun-penjara-kepada-mi\/","title":{"rendered":"Majelis Hakim Pengadilan Negeri Pasbar, Jatuhi Hukuman MI 10 Tahun Penjara"},"content":{"rendered":"<h4><strong>PASAMAN BARAT, Marapi Post.com<\/strong>-Majelis Hakim Pengadilan Negeri (PN) Pasaman Barat, Sumatera Barat, menjatuhkan hukuman 10 tahun penjara terhadap terdakwa berinisial MI (29 tahun), pada sidang Kamis (20\/8\/2026) atas tindak pidana pelecehan seksual terhadap anak di bawah umur.<\/h4>\n<p>\u200bAmar putusan tersebut dibacakan secara terbuka oleh Hakim Ketua Fransiscus Sinurat, S.H., didampingi Hakim Anggota Ade Puspita Dewi dan Safrizalti, serta Panitera Pengganti Martion di Ruang Sidang PN Pasaman Barat.<\/p>\n<p>\u200bDalam putusannya, Majelis Hakim menyatakan terdakwa MI terbukti secara sah dan meyakinkan bersalah melanggar Pasal 473 ayat (4) KUHP juncto UU Nomor 1 Tahun 2026 tentang Penyesuaian Pidana dan UU Nomor 20 Tahun 2025 tentang KUHAP.<\/p>\n<p>\u200bSelain hukuman kurungan badan selama 10 tahun, terdakwa juga dijatuhi pidana denda sebesar Rp50 juta dengan ketentuan wajib dibayarkan dalam waktu satu bulan sejak putusan berkekuatan hukum tetap (inkrah).<\/p>\n<p>\u200bJika denda tersebut tidak dibayarkan, maka harta benda terdakwa akan disita dan dilelang oleh jaksa. Apabila tidak mencukupi, maka diganti dengan pidana penjara selama 50 hari.<\/p>\n<p>\u200bMajelis Hakim turut menetapkan masa penangkapan dan penahanan yang telah dijalani terdakwa dikurangkan seluruhnya dari total masa pidana, dengan status terdakwa tetap berada di dalam tahanan, serta membebankan biaya perkara sebesar Rp5.000.<\/p>\n<p>\u200bDalam pertimbangan hukumnya, Majelis Hakim menegaskan bahwa pemidanaan bukan sarana balas dendam, melainkan pembelajaran dan pembinaan agar terdakwa merenungi perbuatannya dan tidak mengulangi kesalahan serupa. Adapun keadaan yang meringankan, terdakwa tercatat belum pernah dihukum.<\/p>\n<p>\u200bKasus pencabulan ini sebelumnya bermula dari penangkapan MI oleh Tim Kalong Satreskrim Polres Pasaman Barat pada Kamis, 6 November 2025 malam, di kawasan Perumnas Pasaman Indah, Jorong Kampung Cubadak, Nagari Lingkuang Aua Timur, Kecamatan Pasaman.<\/p>\n<p>\u200bPenangkapan tersebut menindaklanjuti Laporan Polisi Nomor: LP\/B\/216\/XI\/2025\/SPKT\/Satreskrim\/Polrespasbar\/Polda Sumbar. 4 November 2025 terkait tindak pelecehan terhadap korban berinisial SM (8 tahun).<\/p>\n<p>\u200bSetelah amar putusan selesai dibacakan, suasana persidangan sempat diwarnai interupsi teriakan dari salah satu pengunjung yang mengaku sebagai orang tua terdakwa, namun situasi dapat segera dikendalikan petugas keamanan.<\/p>\n<p>\u200bAtas putusan tersebut, Jaksa Penuntut Umum Kejari Pasaman Barat Erda Fajarwati maupun terdakwa MI didampingi penasihat hukumnya menyatakan sikap untuk pikir-pikir selama
